PhD Research

All art is at once surface and symbol. Those who go beneath the surface do so at their own peril1

My arts practice to date has dealt with gender issues, in particular masculinity and homosociality. The PhD in Visual Art has provided me with an opportunity to concentrate on and to embrace the issues of gender, arts law, censorship and self-censorship. This has led me to the topic of: The Artist as self-censor in representations of hegemonic masculinity and homosociality2 (working title).

In the 1966 International Covenant on Civil and Political Rights, universal rights ratified by the Australian government it states:

Everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice3.

Even though Australia is a liberal democratic society and the Australian law recognises an adults rights to freedom of choice there are many laws that restrict artists in their freedom of expression. The laws of defamation, obscenity, blasphemy, libel, anti-discrimination, anti-vilification, internet publication, copyright restrictions, (and more recently sedition) may also have the potential to impact on the work of visual artists. Lovric observes for instance that:

While governments espouse adherence to the liberal democratic spirit, which fosters and encourages freedom of expression, many laws in fact fetter those apparent freedoms4.

Despite many myths and fallacies, Australians have no right to freedom of expression under the Australian Constitution. There is only an implied guarantee of freedom of political communication in terms of specific government or political matters5. In Australia, freedom of expression is constrained by the laws of defamation and obscenity. It could be argued that the laws of defamation and obscenity are the complete antithesis to freedom of expression that is so important to artists6

Freedom of expression constitutes one of the essential foundations of a democratic society and one of the basic conditions for its progress and for each individuals self-fulfilment. It is applicable not only to information or ideas that are favourably received or regarded as inoffensive or as a matter of indifference, but also to those that offend, shock or disturb. Such are the demands of pluralism, tolerance and broad-mindedness without which there is no democratic society7.
